Exploiting E-Discovery using Linguistic Pattern Search Technology
The use of linguistic pattern-matching software as a discovery management tool can help identify two types of situations:
- Electronic Spoliation caused by a party failing to produce relevant electronic data that was at one time in its possession, and
- Privilege Waiver caused by a party failing to identify all versions of privileged documents or electronic files and failing to consistently redact privileged portions of documents or electronic files.
To exploit these situations and maximize its benefit, or to minimize their damage to a party's case, they must be discovered within time to permit appropriate action. For the producing party that means before the production has taken place. For the party reviewing the production, that means within time permitted to conduct follow-on discovery requests and motions. This white paper also touches on some of the related procedures and tools that are needed to use pattern-matching software in a timely fashion.

Avoiding or Exploiting Waiver and Spoliation Situations: An Update
This update to the earlier white paper reviews:
- A survey showing that many organizations do not have the procedures in place to avoid electronic spoliation
- The increased focus on electronic discovery and inadvertent waiver by federal and state courts and the proposed new Federal Rule of Evidence 502 dealing with inadvertent waiver
- The use of near-duping technology as a well-advised measure to protect against inadvertent disclosure and to audit for potential electronic spoliation
Also included is a product update on the availability of licenses for Syngence Processing Software.

Related Content Finder: A Search Engine that works
Search has become indispensable in electronic and networked virtual communities. This has led to a large compounded growth in the search product markets, where Google is very visible to the general market. The question being asked by many, "Are these search engines finding what people want?." This presentation discusses this topic in the context of a relatively new search technology called the Relational Content Finder or RCF.
RCF is integrated into the Synthetix Processing Suite (SPS) by Syngence. SPS is fast becoming the dominant search product in their particular market segment of litigation support, since it has been integrated into most of the litigation document tool vendors. The Synthetix customers are dominantly "tech-gnostic" lawyers and paralegals who demand easy to use yet reliable search technology, using "search by example".
